These Terms & Conditions apply to the use of the Dream Adventure Motorcycles website, purchases made through our online store, and workshop services supplied by us.

Dream Adventure Motorcycles is operated by Dream Adventure Motorcycles Pty Ltd (ABN 95 650 077 400), trading as Dream Adventure Motorcycles ("Dream Adventure Motorcycles", "we", "us" or "our").

By placing an order, booking workshop services or otherwise purchasing goods or services from us, you agree to these Terms & Conditions together with any additional terms, quote, booking confirmation or policy that applies to the relevant purchase or service.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights you have under the Australian Consumer Law or other applicable law where those rights cannot lawfully be excluded, restricted or modified.

1. About Our Website

Our website allows customers to:

  • purchase motorcycle parts, accessories, apparel and other products

  • search or identify products that may be suitable for particular motorcycles

  • enquire about or book motorcycle servicing, repairs and other workshop services

  • contact Dream Adventure Motorcycles

  • access information about our products, services and business.

We may update, change or remove website content, products, functionality or services from time to time.

We take reasonable care to ensure information on our website is accurate. However, product descriptions, specifications, images, availability and other information may occasionally contain errors or become outdated.

If we identify an error that materially affects an order you have placed, we will contact you and provide an appropriate option, which may include confirming the corrected information or cancelling the affected item and providing a refund.

2. Product Information and Motorcycle Fitment

We provide product descriptions, specifications and motorcycle compatibility or fitment information to assist customers when choosing products.

Fitment information may be provided by manufacturers, distributors, suppliers or third party data services.

Motorcycle models can vary according to model year, specification, market, previous modifications and individual configuration. You should check that a product is suitable for your particular motorcycle before installation or use.

Where you are unsure about compatibility, we recommend contacting us before purchasing.

If you provide us with motorcycle details for the purpose of identifying a suitable product, please ensure those details are accurate and complete.

Nothing in this section limits your rights where a product does not comply with a consumer guarantee under the Australian Consumer Law.

3. Prices

Unless otherwise stated, prices displayed on our Australian website are in Australian dollars and include GST where applicable.

Prices may change from time to time.

The price applicable to an online order is generally the price displayed when the order is submitted, subject to correction of genuine errors.

Shipping, freight or other applicable charges will be displayed or communicated before you complete your purchase where reasonably practicable.

If a product has been displayed at an incorrect price because of a genuine error, we may contact you before accepting or fulfilling the order. You may choose to proceed at the corrected price or cancel the affected item for a full refund.

4. Payment

Payment for online orders must be made using one of the payment methods made available through our website.

Payments may be processed by Shopify or another authorised payment provider. Use of a particular payment service may also be subject to that provider's terms.

We may withhold dispatch of goods until payment has been successfully received or authorised.

For workshop services, payment is required in accordance with the applicable quote, estimate, invoice, booking confirmation or other arrangement agreed with you.

Unless otherwise agreed, payment for completed workshop services must be made before the motorcycle is released.

5. Online Orders

Submitting an order through our website is an offer to purchase the products contained in that order.

An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that every item has been accepted or is available for fulfilment.

We may decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable

  • there is a genuine pricing or product information error

  • we are unable to obtain the product from our supplier

  • payment cannot be authorised

  • we reasonably suspect fraudulent or unlawful activity

  • we cannot lawfully supply the product.

If we cancel an item after payment has been received, we will refund the amount paid for that item.

We will not cancel an order simply to avoid supplying goods at an agreed price where we are legally required to honour the transaction.

6. Product Availability and Supplier Fulfilment

Some products displayed on our website may be supplied by third party distributors or fulfilment partners.

Stock availability may change without notice, including after an order has been submitted.

Some products may be dispatched directly to you by a supplier or fulfilment partner rather than from Dream Adventure Motorcycles.

Where an ordered product becomes unavailable, we will contact you and may offer:

  • an alternative product, subject to your agreement

  • a revised expected supply timeframe

  • cancellation of the affected item and a refund.

We will not substitute a materially different product without your agreement.

7. Delivery

Delivery options and charges will be displayed during checkout or otherwise communicated to you before fulfilment where applicable.

Any delivery timeframe provided is an estimate unless we expressly agree otherwise.

Delivery may be affected by factors outside our reasonable control, including courier delays, supplier delays, weather, natural events and transport disruptions.

If a significant delay occurs, we will take reasonable steps to keep you informed and provide any outcome required under applicable law.

You are responsible for providing an accurate and accessible delivery address.

If additional delivery costs arise because incorrect or incomplete delivery information was provided, or because a delivery cannot reasonably be completed at the nominated address, we may charge reasonable additional delivery costs where those costs have been disclosed to you.

8. Returns, Refunds and Consumer Guarantees

Goods and services supplied by Dream Adventure Motorcycles may come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, you may be entitled to a repair, replacement, refund, cancellation or compensation where goods or services fail to meet an applicable consumer guarantee.

Your rights under the Australian Consumer Law apply regardless of any manufacturer warranty or other voluntary warranty.

We will not refuse an outcome you are legally entitled to because:

  • an item was purchased on sale

  • a manufacturer's warranty has expired

  • a stated returns period has expired

  • the product packaging has been opened where opening it was reasonably necessary to identify a fault.

A change of mind does not automatically give rise to a right to a refund or exchange under the Australian Consumer Law. Any additional change of mind returns we choose to offer will be subject to our applicable Returns & Refunds Policy.

We may reasonably inspect or assess a product before determining the appropriate outcome for an alleged fault.

Nothing in our Returns & Refunds Policy or these Terms & Conditions limits rights that cannot lawfully be excluded under the Australian Consumer Law.

9. Manufacturer Warranties

Some products may include a warranty provided by the manufacturer, importer or distributor.

Any manufacturer warranty is additional to your rights under the Australian Consumer Law and does not replace or limit those rights.

Where appropriate, we may assist you in communicating with a manufacturer or distributor in relation to a warranty claim.

The existence of a manufacturer warranty does not affect Dream Adventure Motorcycles' obligations as a supplier where those obligations apply under law.

10. Workshop Bookings

Workshop bookings are subject to availability.

When making a booking, you should provide accurate information about:

  • your motorcycle

  • the work requested

  • known faults or symptoms

  • relevant modifications

  • any other information that could reasonably affect diagnosis or repair.

A booking reserves workshop time but does not necessarily constitute a fixed quote for all work required.

Where a booking deposit or cancellation fee applies, the amount and relevant conditions will be disclosed to you before you confirm the booking.

11. Diagnosis and Inspection

Some motorcycle faults cannot reasonably be diagnosed without inspection, testing or dismantling.

Where diagnostic or inspection work is required, we may charge for the time and work involved where the charge or basis of charging has been disclosed to you before that work is undertaken.

Diagnosis may identify additional faults or work that could not reasonably have been identified from the information initially provided.

Completion of diagnostic work does not require you to proceed with any subsequent repair unless you authorise that work.

12. Quotes and Estimates

A quote is an offer to perform the specified work for the stated price and becomes binding when accepted, subject to its stated scope and conditions.

An estimate is an approximate indication of the expected cost and is not a fixed price.

Where we provide an estimate, the final cost may vary where reasonably necessary because of matters such as:

  • faults discovered during inspection or dismantling

  • additional parts or labour that could not reasonably have been identified beforehand

  • changes requested by you

  • supplier price changes before work is authorised

  • additional work authorised by you.

We will not use an estimate as a basis to deliberately understate the expected cost of work.

A quote or estimate may have an expiry date. Where no expiry date is stated, availability and pricing may need to be reconfirmed if a significant period has passed.

13. Additional Workshop Work

We will not undertake material additional repair work that increases the agreed scope or cost without obtaining your authorisation, except where urgent action is reasonably necessary to prevent immediate safety risks or further damage and it is not reasonably practicable to contact you.

Where additional work is recommended, we will endeavour to explain:

  • the additional work required

  • why it is recommended

  • the estimated additional cost

  • any material consequence of postponing the work where relevant.

Authorisation may be provided in writing, electronically, by telephone or through another agreed method.

We may keep a record of your authorisation.

14. Parts Used in Workshop Repairs

Depending on the work authorised, we may use genuine, OEM, aftermarket or other appropriate replacement parts.

Where the type or brand of part is material to the agreed repair, this will be discussed with you as part of the quote, estimate or authorisation process.

We will not knowingly substitute a materially different part from one specifically agreed with you without obtaining your approval, unless the originally agreed part becomes unavailable and you agree to an alternative.

If you request that we install a part supplied by you, we may decide whether to accept that work.

Where we agree to install a customer supplied part:

  • you are responsible for ensuring you have lawful title to the part

  • we do not provide a manufacturer or product warranty for the part itself

  • additional labour may be chargeable if the part is unsuitable, incorrect or defective.

Nothing in this section excludes our responsibility to perform installation services with the level of care and skill required by law.

15. Completion and Collection of Motorcycles

We will contact you when your motorcycle is ready for collection.

Unless otherwise agreed, all amounts properly due for authorised workshop services must be paid before the motorcycle is released.

You should arrange collection within the timeframe communicated to you.

Where a motorcycle remains uncollected for an extended period, reasonable storage charges may apply where the charge and the date from which it applies have been disclosed to you before those charges begin to accrue.

If a motorcycle or other property remains uncollected, we may exercise any rights available to us under applicable Western Australian law, subject to any required notice or procedural requirements.

16. Insurance and Accident Repairs

Where workshop services are connected with an insurance claim, the scope and timing of work may depend on insurer assessment, approval, parts availability or other requirements outside our control.

Unless we have expressly agreed otherwise with you and the insurer, you remain responsible for amounts properly payable for work you have authorised that are not paid by the insurer.

We will not carry out additional insurer related work outside the authorised scope without appropriate approval.

17. Delays in Workshop Services

Any completion date or timeframe provided for workshop work is an estimate unless expressly agreed otherwise.

Repair times may be affected by:

  • availability of parts

  • additional faults discovered during diagnosis or repair

  • specialist or third party services

  • supplier delays

  • insurer approval

  • events outside our reasonable control.

Where a material delay occurs, we will take reasonable steps to notify you.

Nothing in this section limits any rights you may have where services are not supplied within a reasonable time as required by the Australian Consumer Law.

18. Customer Accounts

You may be able to create a customer account through our website.

You are responsible for:

  • keeping your login details secure

  • providing accurate account information

  • notifying us if you believe your account has been accessed without permission.

You must not use another person's account without their authority.

We may suspend or restrict an account where reasonably necessary to protect our website, customers or business from fraud, misuse, security threats or unlawful activity.

19. Website Use

You must not use our website:

  • for an unlawful purpose

  • to infringe another person's rights

  • to introduce malicious code, viruses or other harmful technology

  • to attempt to gain unauthorised access to our systems

  • to interfere with the security or operation of the website

  • to scrape, reproduce or commercially exploit website content without permission where such use is not otherwise permitted by law

  • to submit false, misleading or fraudulent information.

We may restrict access to the website where reasonably necessary to protect the website, our systems, our business or other users.

20. Intellectual Property

Unless otherwise stated, the content of this website, including text, branding, graphics, photographs, layouts and other original material, is owned by or licensed to Dream Adventure Motorcycles.

You may view and use website content for personal and legitimate purchasing purposes.

You must not reproduce, distribute, modify or commercially exploit our original website content without permission, except where permitted by law.

Third party trademarks, product names and logos remain the property of their respective owners.

Reference to a manufacturer or motorcycle brand does not imply that Dream Adventure Motorcycles is an authorised dealer, agent or representative of that brand unless we expressly state otherwise.

21. Reviews and User Submitted Content

If you submit a review, testimonial, photograph or other content to us for publication, you confirm that:

  • the content is genuinely yours or you have permission to provide it

  • it does not knowingly infringe another person's rights

  • it is not unlawful, fraudulent or defamatory.

Where you give us permission to publish that content, you grant us permission to reproduce and display it for the purpose for which it was provided.

We will not materially alter a customer review in a way that misrepresents the customer's opinion.

22. Third Party Websites and Services

Our website may contain links to third party websites or use services provided by third parties.

We do not control third party websites and are not responsible for their content, availability or independent practices.

Use of third party services may be subject to separate terms and privacy policies.

23. Privacy

Our collection, use and disclosure of personal information is described in our Privacy Policy.

By using our website or purchasing goods or services from us, you acknowledge that personal information will be handled as described in that policy and as otherwise permitted or required by law.

24. Promotions and Discount Codes

Promotions, discount codes and special offers may be subject to additional conditions disclosed with the relevant offer.

Unless otherwise stated:

  • promotions cannot be combined

  • discount codes must be entered before completing checkout

  • discounts do not apply retrospectively to previous purchases

  • promotions are subject to product availability.

We will not change the terms of a promotion retrospectively after you have completed a qualifying transaction.

25. Liability and the Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee or other right available under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable law where it would be unlawful to do so.

To the extent permitted by law, Dream Adventure Motorcycles is not responsible for loss or damage caused by:

  • use of a product contrary to the manufacturer's instructions

  • incorrect installation, modification or repair performed by another person after the product leaves our control

  • customer misuse, neglect or unauthorised modification

  • inaccurate motorcycle or fitment information supplied by the customer

  • circumstances outside our reasonable control.

This section does not apply to the extent that the loss or damage was caused or contributed to by Dream Adventure Motorcycles or where liability cannot lawfully be excluded or limited.

26. Events Outside Our Reasonable Control

We are not responsible for delay or failure to perform an obligation to the extent the delay or failure results from circumstances genuinely outside our reasonable control.

This may include significant transport disruption, natural disasters, severe weather, supplier interruption, widespread system outages or government restrictions.

Where such an event materially affects an order or service, we will take reasonable steps to communicate with you and minimise the impact.

Nothing in this section removes any rights you have under applicable law.

27. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our website, business, services or applicable law.

Any updated Terms will apply to transactions entered into after the updated Terms take effect.

We will not retrospectively change the agreed terms of an existing order, booking or contract simply by updating these website Terms.

The current version and effective date will be published on our website.

28. Severability

If any part of these Terms & Conditions is found to be invalid or unenforceable, that provision will be read down where possible or otherwise severed to the extent necessary.

The remaining provisions will continue to apply.

29. Governing Law

These Terms & Conditions are governed by the laws of Western Australia and the Commonwealth of Australia, as applicable.

Nothing in this section limits any rights you may have to bring a claim or pursue your legal rights in another jurisdiction where applicable law allows you to do so.
